Terms and Conditions for That Fence Company

1. Introduction: These terms and conditions govern the contractual agreement between That Fence Company (referred to as "we," "us," or "our") and the customer (referred to as "you" or "your") for the provision of fence installation services. By engaging our services, you agree to be bound by these terms and conditions. 

 2. Services: We offer professional fence installation services, including but not limited to design, supply, and installation of fences. Our services are subject to availability and may vary based on your specific requirements. 

3. Pricing and Payment: 

A) The pricing for our services will be provided to you in a written estimate or quotation, which will include the cost of materials, labor, and any additional charges. 

B) A deposit is required to secure your booking and initiate the fence installation process. The deposit amount will be communicated to you during the quotation process. 

C) Full payment of the remaining balance is due upon completion of the fence installation, unless otherwise agreed upon in writing. 

D) If the final balance is not paid within the agreed-upon timeframe, we reserve the right to repossess the installed fence until payment is made in full. 

4. Cancellation and Refunds: 

A) If you wish to cancel your fence installation project, you must notify us in writing as soon as possible. Cancellation charges may apply, depending on the stage of the project and any costs incurred. 

B) In the event of cancellation within three (3) days of making the deposit, you are entitled to a full refund of the deposit amount. 

C) Refunds, if applicable, will be processed within thirty (30) days from the date of cancellation. Please note that the refund may take additional time to reflect in your account, depending on your bank or payment provider. 

5. Warranty and Liability: 

A) We warrant that our fence installation services will be performed with reasonable care and skill, in accordance with industry standards. 

B) Any materials supplied by us will be covered by the manufacturer's warranty, if applicable. We will provide you with the necessary warranty information upon completion of the project. 

C) We shall not be liable for any damages, losses, or claims arising from the use or misuse of the installed fence, including but not limited to accidents, injuries, or property damage. 

D) Our liability for any breach of these terms and conditions or any negligence on our part shall be limited to the total amount paid by you for the fence installation services. 

6. Intellectual Property: 

A) Any intellectual property rights, including but not limited to designs, plans, or drawings, created or provided by us during the fence installation process shall remain our property. 

B) You are prohibited from reproducing, distributing, or using any of our intellectual property without our prior written consent. 

7. Entire Agreement: 

These terms and conditions constitute the entire agreement between That Fence Company and the customer, superseding any prior agreements or understandings, whether written or oral. By engaging our services, you acknowledge that you have read, understood, and agreed to these terms and conditions, including the provision that the installed fence may be repossessed if the final balance is not paid.
